A week after announcing it would replace the wrist straps on 3.2 million Wii game controllers, Nintendo has been hit with a class action law suit.

The action seeks damages for "Nintendo's failure to include a remote that is free from defects" and contends NIntendo's failure is in breach of Nintendo's own product warranty.

At issue is the strength of the plastic wrist strap designed to keep the Wii's wand-like controller from slipping from exuberant users hands. The controller, which responds to body motion, sometimes is waved wildly as gamers play sports games like tennis and bowling.

Nintendo said it would replace the straps on its controllers with thicker ones, while urging players to show a little restraint in their arm and hand movements. The company had received reports of users accidentally flinging their controllers across the room, damaging windows, lamps and TV screens.

GamePro.com, a video game site, quotes a company official as saying the suit is totally groundless because the company is in the process of replacing the controller straps at no charge.

Nintendo released the Wii game console November 17th and said it expected to sell 4 million units by the end of the year.

Yahoo, it time for everyone to cash-in on class action lawsuit. Join in the suit for Nintendo deceptive and fraudulent practices. Nintendo building a defective product with a potential to hurt children. I wonder how many children has gotten hurt too beside adults.

Nintendo’s failure to include a remote that is free from defects is in breach of Nintendo’s own product warranty.

The class action lawsuit seeks to enjoin Nintendo from continuing its unfair or deceptive business practices as it relates to the Nintendo Wii.The lawsuit also seeks an injunction that requires Nintendo to correct the defect in the Wii remote and to provide a refund to the purchaser or to replace the defective Wii remote with a Wii remote that functions as it is warranted and intended. Note: Youtube has growing number of Nintendo Wii videos injuries. They are real injuries even though some are in humorous clip.

For those think it fake, I doubt many people will go in such elaborate creations to make a fake video. Thus, the lawsuit is real. The injuries are real! It no Xbot or PS3 Box fanboy conspiracy. It not a global conspiracy. This is reality. People are getting injury from Nintendo Wii controllers.

Guess what? Some people buying a $250+ Nintendo Inferior Wii Console to avoid paying $400 to $600 + superior Xbox 360 or PS3. Now has to pay additional $$$ for medical services, injuries, replacement to damage TVs, Light Fixtures, etc. Replacing a HDTV or Plasma screen even under warranty, cost $$$. Even a simple bandage cost like 10 cents.

Okay, it has come apparent u dont read posts where people directly reply to u. So i dont even know the point of responding to your peanut head if u cant register to read and comprehend what i m telling you.

Having said that:

The wii strap is an insurance policy. First of all, people are not suppose to let go of the controller, period. No if's, no buts. The strap is there JUST IN CASE you let go of the controller.

I really do not understand the logic behind this line:

>>NO, the dumb@sses let go of the controller with such force that the strap broke. No where in the instructions manual does it encourage you to let go of the freak'n controller. However strong or weak the strap is, it is theoritically not needed since the person isnt suppose to let go. Simple.

Come to think about it, its like people who swing their golf club and let go, and then blame the darn golf club for letting it GO?!

Does anyone else comprehend the idoicy behind this lawsuit?

In any respect, these kind of frivolous lawsuits are pretty common when the consoles get launched. Case in point:

Microsoft is facing another class action lawsuit over its Xbox 360 console and allegations of faultiness. This time, the suit centers on the Fall Update and claims that patch caused total system failure for some gamers.

The lawsuit comes out of California where gamer Kevin Ray is seeking out more than $5 million in damages and the free repair of all consoles messed up by the update.

Microsoft tried to charge $140 to fix the machine.

Ray claims the updated “bricked” his console and he’s certain it’s happened to others.

Microsoft, for its part, has acknowledged the problem and promised to fix consoles impacted by the update. Where this suit will go is anyone’s guess, but Microsoft has done a pretty good job in the past of stepping up to the plate to fix things (when pressure was applied).

That's two class action lawsuits for the 360 in a little over a year. I'm sure Sony will soon be slapped with a couple lawsuits pretty soon too - probably over the scaling/backwards compatibility fiasco maybe?

These companies getting sued is just par for the course in this country, unfortunately.

No body getting hurt from using Xbox 360 or causing damage to property. People are getting hurt using and playing the Nintendo Wii. There is a different between the Xbox 360 suits and Nintendo Wii. Xbox 360 are frivolous. Nintendo Wii are legitimate lawsuit from people truly getting hurt from Nintendo careless cost cutting half-baked straps. Nintendo wanted to sell Nintendo Wii as low possible to grab market share. So Nintendo using substandard straps. My guess, Nintendo original intent is to make as much money selling replacement straps at high inflated prices. Make tons of money on replacement straps.

Guess what? You pay $250 for Nintendo Wii. So every few months you will pay estimated $10-20 for replacement straps. You can pay more for designer straps and straps in different colors. As long as the straps keep breaking, Nintendo will make up the difference on additional straps. E.G. Future Prodcuts: $25.00 for the designer Links strap. $20.00 Mario or Luigi Design Strap. $15.00 Cute Pink Strap. $12.00 for Black Strap.

Read your own article again, you illiterate tool. There is NOTHING in there regarding injury OR property damage. In fact, in the actual Wii operations manual it clearly states all the safety precautions, as well as having safety precautions before the start of the system or any games, thus all liability for injury OR property damage is passed on to the the user.

I.E. If people are acting like total morons and flailing around like a monkey or throwing the Wiimote around, and it breaks something or hurts somebody, it is their own responsibility.

Guess what? You pay $250 for Nintendo Wii. So every few months you will pay estimated $10-20 for replacement straps. Personally, I don't even use the wrist strap because I lay my controller down frequently to take a drink of whatever I'm drinking. Being that I'm not a fumble fingered flailing moron, I feel comfortable with the risk, and if I do ever fling my controller, it would be my own fault.

Here's the thing though asshat, the old straps do not break easily, check out this picture of the Wii strap holding 25 pounds of books and 100 fl oz of Mountain Fresh laundry detergent:

The guy conducting this break-test was only finally able to break it by grabbing it and pulling with all his strength. I'm guessing MOST accidents and "injuries" are stupid clumsy asses like you who weren't even using their strap in the first place.

And now it is not an issue at all because the new straps are even stronger.

A radio station had a contest "Hold your Wee for a Wii" where whoever drank the most water without pissing themselves won a Nintendo system. One of the contestants died of water intoxication.

Instead of just chalking it up to stupidity on the contestants part, or even blaming the DJ's, perhaps the "victims" can sue Nintendo for making a system so fun and irresistable people will die trying to get their hands on one.
